Terms & Conditions

For deliveries and services by fine carwash tools (owner Christian Hörwey), the "Seller", to business customers. As of: June 2026.

Terms for B2B sales in Austria (sales to businesses, not consumers). We recommend having them reviewed by a lawyer / the WKO before going live. Austrian law applies.

1. Scope

These terms apply to all contracts between the Seller and customers who are entrepreneurs within the meaning of § 1 UGB (Austrian Business Code). Consumer transactions are not covered. Deviating terms of the customer apply only with express written consent.

2. Conclusion of contract

The Seller's offers are non-binding. A contract is concluded by the Seller's written order confirmation or by delivery. Enquiries via the contact form do not constitute a binding offer.

3. Prices & payment

All prices are net prices in euros plus statutory VAT, ex works (EXW, Incoterms 2020) unless agreed otherwise. Payment is due upon receipt of the invoice without deduction, unless agreed otherwise. Default interest applies pursuant to § 456 UGB.

4. Delivery & passing of risk

Delivery dates are non-binding unless expressly agreed as binding. Risk passes to the customer upon handover to the carrier. Partial deliveries are permitted.

5. Retention of title

The delivered goods remain the property of the Seller until all claims arising from the business relationship have been paid in full.

6. Warranty & guarantee

The statutory warranty provisions for business transactions apply. The customer must inspect the goods immediately upon receipt and give written notice of defects without delay pursuant to § 377 UGB. In addition, the Seller grants a manufacturer's guarantee of 2 years on all parts.

7. Liability

The Seller is liable only for intent and gross negligence. Liability for slight negligence is excluded, except for personal injury. Liability under the Product Liability Act remains unaffected.

8. Installation & operation

Installation is carried out in accordance with the assembly instructions. No liability is accepted for damage caused by improper installation, operation or maintenance outside the Seller's specifications.

9. Data protection

The processing of personal data is governed by our Privacy Policy.

10. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Place of jurisdiction is the Bezirksgericht Mistelbach (district court). Should individual provisions be invalid, the validity of the remainder is unaffected.
